Terms & Conditions:
1. Scope of Services
Huckleberry Home AV provides residential audiovisual installation services including, but not limited to, television mounting, audio system installation, projector setup, wire concealment, and related services.
Services are limited strictly to those described in the written estimate or invoice. Any work not expressly included is excluded.
All services are performed based solely on visible and reasonably observable site conditions at the time of installation.
2. Site Conditions & Concealed Hazards
Client acknowledges that walls, ceilings, floors, fireplaces, and other surfaces may contain concealed elements including but not limited to electrical wiring, plumbing, gas lines, structural framing, metal studs, fire blocking, insulation, or prior repairs.
Huckleberry Home AV is not responsible for damage to concealed or undisclosed elements that are not reasonably detectable prior to installation.
Client assumes all risks associated with unknown site conditions.
If concealed conditions are discovered during installation, work may pause until revised scope and pricing are approved.
3. Structural Integrity & Surface Suitability
Client represents that all mounting surfaces are structurally sound and suitable for installation.
Huckleberry Home AV shall not be responsible for failure resulting from improper framing, structural defects, non-standard construction, defective drywall, masonry weakness, or pre-existing structural issues.
Final mounting method is determined at technician discretion in the interest of safety.
4. Customer-Supplied Equipment
Installation of customer-supplied televisions, mounts, brackets, hardware, cables, or accessories is performed at the client’s sole risk.
No warranty, express or implied, is provided for customer-supplied products.
Huckleberry Home AV reserves the right to refuse installation of equipment deemed unsafe or incompatible.
5. Specialty Installations
Installations involving brick, concrete, tile, stone, fireplaces, motorized mounts, recessed back boxes, Samsung Frame models, or large-format displays may require additional labor and specialty hardware.
Client agrees pricing may adjust based on structural requirements discovered on site.
Exact model numbers are required for accurate quoting of specialty displays.
6. Cosmetic Conditions
Minor surface markings, pilot holes, compression, and incidental cosmetic imperfections may occur during installation.
Drywall finishing, texture matching, paint repair, and cosmetic restoration are not included unless explicitly agreed in writing.
7. Pricing & Adjustments
All “Starting At” pricing reflects standard drywall installations with accessible wood studs.
If additional labor, reinforcement, specialty anchoring, concealment, or hardware is required, pricing will adjust accordingly.
Client approval of adjustments may be verbal or written.
8. Payment Terms
Full payment is due immediately upon completion of services unless otherwise agreed in writing.
Accepted payment methods include cash, Venmo, PayPal, and all major credit and debit cards.
Checks are not accepted under any circumstances.
Late balances may accrue interest at the maximum rate permitted by Texas law.
Client agrees to reimburse reasonable collection costs, including attorney’s fees where permitted by law.
9. Deposits
Deposits may be required for specialty hardware, mounts sourced by Huckleberry Home AV, large-format installations, or whole-home packages.
Deposits are non-refundable once materials have been ordered.
10. Cancellation & Rescheduling Policy
Appointments cancelled more than 48 hours prior to the scheduled service time will not incur a fee.
Cancellations within 48 hours may be subject to a fee of up to 25% of the scheduled service estimate.
Cancellations within 24 hours, or failure to provide access at the scheduled time, may result in a fee of up to 50% of the scheduled service estimate.
Reschedule requests within 48 hours may incur a $75 rescheduling fee.
Reschedule requests within 24 hours may incur a fee of up to $125 depending on project size.
If technician arrives and access is not available, client will be responsible for a $125 service call fee.
11. No Chargebacks / Payment Disputes
Client agrees not to initiate payment disputes or credit card chargebacks without first providing written notice and a reasonable opportunity to resolve the issue.
Improper chargebacks may be pursued as breach of contract.
12. Limitation of Liability
To the fullest extent permitted by law, Huckleberry Home AV’s total liability for any claim arising out of services rendered shall not exceed the total amount paid for the specific service provided.
Huckleberry Home AV shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, lost income, property damage beyond the installation area, or equipment malfunction unrelated to workmanship.
13. Indemnification
Client agrees to indemnify, defend, and hold harmless Huckleberry Home AV from any claims, damages, or liabilities arising from customer-supplied equipment, undisclosed site conditions, structural deficiencies, or third-party modifications.
14. Photography & Marketing Release
Unless client provides written notice prior to installation, client grants permission for Huckleberry Home AV to photograph completed work for portfolio and marketing purposes. No personal identifying information will be disclosed without consent.
15. Force Majeure
Huckleberry Home AV shall not be liable for delays or failure to perform due to events beyond reasonable control, including weather, supply chain disruptions, acts of God, or governmental restrictions.
16. Dispute Resolution
Any dispute arising out of services rendered shall first be submitted to good-faith mediation in the State of Texas.
If mediation fails, disputes shall be resolved by binding arbitration conducted in Texas.
Client waives the right to file suit in court except to enforce an arbitration award.
17. Waiver of Jury Trial
To the fullest extent permitted by law, both parties waive the right to a trial by jury for any claim arising out of services rendered.
18. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms & Conditions constitute the entire agreement between Huckleberry Home AV and the client and supersede any prior verbal or written representations.
By scheduling service, approving an estimate, or permitting installation to proceed, client acknowledges and agrees to these Terms & Conditions in full.
